GolfStatus’s Privacy Policy provides clarity about the information we collect and explains how we use that information to provide a better experience. You accept our Privacy Policy by registering or installing our GolfStatus application (the “Service”) or visiting our website at https://golfstatus.com/ (the “Website”), and you consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy.

CCPA NOTICE: We adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”). Any terms defined in the CCPA have the same meaning when used in this Privacy Policy.

Introduction

In this Policy, “GolfStatus” refers to GolfStatus and its affiliates, which shall mean subsidiaries, parent companies, joint ventures and other corporate entities under common ownership. We may also refer to GolfStatus as “We” or “Us.” This Privacy Policy describes:

·         the information we collect, the collection process and the purposes of collection

·         how we use and with whom we share such information

·         how you can access and update such information

·         the choices you can make about how we collect, use and share your information

·         how we protect the information we store about you

The Privacy Policy applies to information we collect:

·         On the Website

·         In email, text, and other electronic messages between you and GolfStatus

·         Through the Service

·         When you interact with our advertising and applications on third-party website and services, if those applications or advertising include links to this policy

It does not apply to information collected by:

·         Us offline or through any other means, including on any other website operated by GolfStatus or any third party; or

·         Any third party through any applications, website, or content (including advertising) that may link or be accessible through the Website or Service

If you access our Service from a third party Social Networking Site (“SNS”), you may be required to also read and accept the SNS’s Terms of Service and Privacy Policy.

Information GolfStatus Collects

We collect several types of information from and about users of our Website and Service, including information:

  • By which you may be personally identified, such as name, postal address, email address, telephone number, gender, or birthday ("personal information");

  • That is about you but individually does not identify you;

  • About your internet connection, the equipment you use to access our Website, and usage details.

We collect this information:

  • Directly from you when you provide it to us.

  • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies.

  • From third parties, for example, our business partners.

The personal information we collects through the Website and Service may include the following (as categorized by CCPA):

  • Identifiers you provide directly such as email address, name, phone number, postal address, online identifier, unique personal identifier, or other similar identifiers

  • Personal information categories identified in the California customer records statute such as email address, name, phone number, or postal address

  • Protected classification characteristics such as gender

  • Commercial information such as records or products or services purchased

  • Identifiers collected through use of the services, such as unique online or device identifiers, IP address, device or session IDs and information regarding your system configuration (operating system and version), network, and connected hardware (e.g., computer or mobile device and carrier) and software applications (e.g., other applications installed on mobile device)

  • Internet and other network activity, such as browsing and search history; and interactions with a website or application

·         Geolocation data

We do not collect biometric information; sensory data; education information, employment related  information, education information, or inferences drawn from other personal information.

Information Received from an SNS

When you use the GolfStatus Service at an SNS such as Facebook, where our Service is also referred to as an “application,” you allow GolfStatus to access certain information from your profile for that site. The information you allow GolfStatus to access varies by SNS platform, and it is affected by the privacy settings you establish at the SNS. You can control and find out more about these settings at the SNS where you use our Service. For example, GolfStatus may access and store some or all of the following information:

  • your first and last name

  • your profile picture or its URL

  • your user ID number, which is linked to publicly available information such as name and profile    photo

  • the user ID numbers for your friends who are also connected to the Service

  • the login e-mail you provided to that SNS when you registered

  • your physical location and that of your access devices

  • your gender

  • your birthday

 

By using GolfStatus through an SNS, you are authorizing GolfStatus to collect, store, and use in accordance with this Privacy Policy any and all information that you agreed the SNS could provide to GolfStatus through the SNS Application Programming Interface (“API”). Your agreement takes place when you “accept” or “allow” (or similar terms) our application on an SNS.

Information GolfStatus Collects Directly from You

When you interact with GolfStatus directly (via an SNS or the Service), on the Website, or another GolfStatus-owned website, we may collect and store information directly from you as described below:

Registration Information

When you register with GolfStatus, you may be required to provide the following information:

  • your first and last names

  • your e-mail address (which must be a valid e-mail address)

  • a password and other information that helps us confirm that it is you accessing

  • your account

We may also offer you the option to complete a user profile that is visible to other GolfStatus users. Your user profile may include:

  • a profile photo

  • one or more username(s)

  • your gender

  • biographic details that you provide

  • links to your profiles on various SNS

  • your address

  • a GolfStatus user ID number, created by GolfStatus and used to identify your

  • profile

You also may provide information to be published or displayed on public areas of the Website, or transmitted to other users of the Website or Service or third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk. We cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

The GolfStatus user ID number used to identify your account and profile will be public and will appear in the URL of your profile page. Your first and last names and profile picture are considered public on the GolfStatus Service and search engines may index this publicly available information. If you choose to provide your location information, this information is also considered public and search engines may index this information. We may also offer you the ability to import your address book contacts or manually enter email addresses so that you can (i) locate your contacts on GolfStatus; and (ii) invite those contacts to join you on our Service. We will store those contacts for purposes of helping you and your contacts make connections on our site. Passwords provided to GolfStatus for the purpose of accessing your address book will not be stored.

Information GolfStatus Receives or Collects When You Access the Service on a Mobile Device

If you access GolfStatus on your mobile device, we may collect your telephone number, country, device type, IP Address and other information you choose to provide, such as user name, name, location or e-mail address (i.e. to receive updates about the Service). If you choose to share your location data while using the Service, we will use your location information for the purposes of showing you nearby places, verifying your location (to stop cheaters), and enabling you to access other location-based features of the Service.

Payment Information

If you purchase virtual currency or goods from GolfStatus, we will collect the billing and financial information necessary for our third-party payment processors to process your charges, including your postal and e-mail addresses. GolfStatus may also receive the billing and payment information that you provide when you purchase GolfStatus virtual goods or currency via a mobile device, such as an iPhone. We use and store this data in the same manner as billing and payment data collected from non-mobile visitors to our Service. Our Terms of Service explain our policies and terms relevant to our charges and billing practices.

Customer Support Correspondence

When you ask for assistance from Us, we will collect and store the contact information you provide (generally your name and e-mail address), information about your activity on the Service, and your user ID number. We will also store the correspondence and any information contained within.

Push Notifications

We may send push notifications to your mobile device to provide in-app updates and other relevant messages. You can manage push notifications from your device’s settings page for GolfStatus.

Technical and Usage Information

When you access the Service, We collect (i) certain technical information about your mobile device or computer system, including IP Address and (ii) usage statistics about your interactions with our Service. This information is collected through the use of server log files and tracking technologies to collect and analyze certain types of technical information including cookies. Some of the cookies the Service places on your computer are linked to your user ID number(s).

How GolfStatus Collects Information about You

We may collect information about you in any one or more of the following ways: Information about Users and Use When you use GolfStatus, We collect and store certain profile information that you provide directly or through the SNS or other third-party website that is offering our Service. To provide a richer experience, we also collect information about your use and interaction with other users and the Service. The bulk of this information is collected and stored through the use of web logs, which are files on our web servers that record actions taken on our Service.

Communications Features

You may be able to take part in certain activities on our Service that give you the opportunity to communicate or share information with GolfStatus and other GolfStatus users. These may include:

  • participating in user forums and message boards

  • posting public comments to other users’ profiles

  • sending private messages or invitations to other users, either directly on our websites or to their e-mail accounts

  • posting photos

We may record and store archives of these communications on GolfStatus’s servers to protect the safety and well-being of our users and GolfStatus’s rights and property in connection with the Service you acknowledge and consent to the recording and storage of such communications for these purposes.

Cookies and Automated Information Collection

When you access our Service, we collect certain technical information in order to (i) analyze the usage of our Service, which allows us to improve the Service, (ii) provide a more personalized experience and (iii) manage advertising. We and other service providers acting on our behalf, such as Google Analytics, use server log files and tracking technologies to collect and analyze certain types of technical information, including cookies, IP addresses, browser types, browser language, referring and exit pages, and URLs, platform type, the number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, service state and the date and time of activity on Service, and other similar information. In some cases, we will associate this information with your user ID number for our internal use. We may also employ other technologies including (i) web beacons, which allow us to determine if a certain page was visited or whether an e-mail was opened; (ii) tracking pixels, which allow us to advertise more efficiently by excluding our current users from certain promotional messages or identifying the source of a new installation; (iii) local shared objects also known as flash cookies, which help us prevent fraud, recall user settings for features and track your progress on certain tasks. You can set your web browser to warn you about attempts to place cookies on your computer, or limit the type of cookies you allow. Flash cookies operate differently than browser cookies and cookie management tools available in a web browser will not remove flash cookies. If you disable cookies, you may lose some of the features and functionality of our Service. Please note that companies that advertise on our Service may also use cookies or other technologies that are subject to the advertising companies’ own policies. Information about your device We may collect some or all of the following information about your device: device identifiers, which may include Mobile Android Advertising ID (ADID)*, iOS Advertising ID (IDFA)*, MAC address, International Mobile Equipment Identity (IMEI), or other unique device identifiers; device type (e.g., mobile, tablet); type and version of operating system (e.g., Android, iOS); network provider; IP address; mobile browser (e.g. Safari, Chrome, etc.); the carrier user ID (a number uniquely allocated to you by your network provider); timestamp; signal strength; API key (identifier for application); Publisher App version; manufacturer and device model; language setting; time zone; country; device language; DMA (Advertising Region); zip code; network status type (such as WiFi).

Mobile Advertising Identifier (MAID) Definition

Most modern mobile devices (iOS 6, Android 2.3, and Windows 10 and above) provide mobile advertising identifiers. These are randomly-generated alphanumeric codes that are associated with your device that often come with options to reset the identifier and opt-out of Cross-App Advertising. These identifiers have different names depending on the operating system. For example, they are called Google Advertising ID (GAID) on Android devices whereas on iOS, they are called Identifiers for Advertisers (IDFA). They are included to provide advertisers a method to identify your devices without using a permanent device identifier, like your phone's serial number.

Other Sources

We may collect or receive information from other sources including (i) other GolfStatus users who choose to upload email contacts, and (ii) third-party information providers.  Information collected from other GolfStatus users will be used to supplement your profile—primarily to help you and your friends connect. Information from third-party information providers may be used for marketing activities, including targeted advertising. Both types of information will be combined with other information we collect.

How Your Information is Used

In general, we collect, store and use your information to provide you with a safe, efficient, and customized experience. For example, We may use information collected from you in any one or more of the following ways:

  • to register your GolfStatus account

  • to administer and improve our Service

  • to identify and suggest connections with other GolfStatus users

  • to enable user-to-user communications

  • to provide technical support and respond to user inquiries

  • to prevent fraud or potentially illegal activities

  • to enforce our Terms of Service

  • to notify users of updates

  • to provide leader boards and promote user achievements

  • to solicit input and feedback to improve the GolfStatus Service and customize your user experience

  • to resolve disputes, collect fees, and troubleshoot problems

  • to analyze trends and user traffic and gather statistical information

  • to inform users about new products or promotional offers

GolfStatus will use your e-mail address to (i) respond to customer support inquiries, and (ii) keep you informed of your activity. We may also send promotional e-mail messages (“Promotional Communications”) directly or in partnership with parties other than GolfStatus.

You always have the choice to stop receiving Promotional Communications. When you receive a Promotional Communication from us you will have the opportunity to “opt out” by (i) following the “unsubscribe” instructions provided in the Promotional Communication you receive or (ii) by editing your preferences. Please note that despite your indicated e-mail preferences, we may still send you administrative messages regarding the GolfStatus Service, including, for example, administrative confirmations, and notices of updates to our Policies. How Your Information is Shared

We will share your information (in some cases personal information) with third parties in the following circumstances:

Third-Party Service Providers

We will provide your information to third-party companies to perform services on our behalf, including payment processing, data analysis, e-mail delivery, hosting services, customer service and marketing.

Friends and Other GolfStatus Users

Other users will be able to see your user name or pseudonym and your user profile. Your user profile may include your profile photo. Access to this information may allow others to view the public information associated with your related SNS account.

Third-Party Product and Service Advertising

We do not actively share personal information with third-party advertisers for their direct marketing purposes unless you give us your consent. If we wish to share in this fashion, we will ask for your consent. Advertisers, however, may obtain public information about you from your profile or other public sources. We may use and share with third parties certain technical information (including IP addresses) or aggregated information to show general demographic and preference information among GolfStatus users. We may also allow advertisers to collect technical or aggregated information tracking with technologies like cookies and web beacons. The information collected may be used to (i) offer targeted ad-selection and delivery in order to personalize your user experience and (ii) undertake web analytics (i.e. to analyze traffic and other end user activity to improve your experience).

Our collection, use, and disclosure of anonymous and aggregated information are not subject to any of the restrictions in this Privacy Policy.

Safety, Security and Legal Compliance

Your information, and the contents of your private online communications, may be accessed and disclosed (i) in response to legal process (for example, a court order, search warrant or subpoena); (ii) when we have a good faith belief that we are required to disclose the information in response to legal process; (iii) in other circumstances in which GolfStatus believes the GolfStatus Service is being used in the commission of a crime (including exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction); (iv) when we have a good faith belief that there is an emergency that poses a threat to the safety of you or another person; and (v) when necessary either to protect the rights or property of GolfStatus including to enforce our Terms of Service, or for us to render the service you have requested.

Sale or Merger

In the event that GolfStatus undergoes a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, we may transfer all of your information, including personal information, to the successor organization in such transition. If material changes to GolfStatus’s privacy practices will occur as a result of the business transition, we will notify you and other users of the business transition prior to transferring your personal information.

Consent

We may share your information in any other circumstances where we have your consent.

We may share your personal data by disclosing it to a third party for a business purpose. We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the personal data confidential, and prohibit using the disclosed information for any purpose except performing the contract. In the preceding twelve (12) months, GolfStatus has disclosed personal data for a business purpose to service providers, affiliates, and partners.

In the prior 12 months, we have not sold for a commercial purpose your personal data to third parties.

We share personal data with third parties for cross-context behavioral advertising.  If you are a California resident and would like to opt out of the sharing of your data, please click “Do Note Sell or Share My Data” at the bottom of the page.

Minors

Our Service is not intended for children under the age of 13 and we do not knowingly collect any personal information from such children. Children under the age of 13 should not use our Service at any time. In the event that we learn that we have inadvertently gathered personal information from children under the age of 13, we will take reasonable measures to promptly remove the display of such information.  If you believe we might have any information from or about a child under 13, please contact us at [email protected].

How to Access and Update Your Information

Information We Receive From an SNS Where You Use GolfStatus

To manage the information GolfStatus receives about you from the SNS where you use GolfStatus, you will need to follow the instructions at that site for updating your information and changing your privacy settings. Once GolfStatus receives your information from an SNS, that information is stored and used by GolfStatus in accordance with this Privacy Policy, and you may access and update that information as described below.

Access and Control of your Account and Erasure of your information If you want GolfStatus to delete your account and erase your information, you may send an e-mail to [email protected]. Place “Delete My Account and Erase My Information” in the subject line and include your first name, last name, e-mail address, and user ID number for the SNS from which you access our Service (if applicable) in the body of the e-mail. We will respond to your request within thirty (30) days. Please note that certain records, for example those pertaining to payments or customer service matters, will be retained for legal and accounting purposes. If you have sent or posted content on the service, we may not be able to delete it. You can turn off push notifications by visiting your device’s settings page for GolfStatus. You can stop further use of your geo-location (for example through “check-ins”) by visiting your device’s settings for GolfStatus. You can also stop checking in. If you wish to review or change the information GolfStatus has about you, e-mail us at [email protected].

Sharing and Messaging Options

Information GolfStatus Receives from Third-Party SNS Where You use GolfStatus If you use our Service at a third-party SNS, GolfStatus will be able to access and store profile and other information about you as described above. The categories of information you share with us will depend, in part, on the privacy settings you have established at the SNS where you access the application. Many SNS allow you to control how you share information with third-party applications and websites, such as GolfStatus, through your privacy settings on each SNS. GolfStatus does not control what privacy settings those sites make available to their users, so we refer you to the privacy policies that are posted on those sites to learn what options they make available to their users. GolfStatus does not offer an “opt out” option for specific fields that are shared by the SNS where you access and use GolfStatus.

Opting out of Promotional Communications

You can choose to opt out of receiving additional promotional e-mails from GolfStatus by clicking on the “unsubscribe” link in any such e-mail. Please note that once we receive your request, it may take an additional period of time for your opt-out to become effective.

Note that if you opt-out of our Promotional Communications, we may still e-mail or communicate with you from time to time if we need to provide you with information or if we need to request information from you with respect to a transaction initiated by you or for other legitimate non-marketing reasons.

Privacy Policies of Linked Sites and Advertisers

Our Service may contain advertisements from companies other than GolfStatus with their own websites. We are not responsible for the privacy practices or the content of such websites. If you have any questions about how these other websites use your information, you should review their policies and contact them directly.

Information Security

GolfStatus implements reasonable security measures to protect the security of your information both online and offline, and we are committed to the protection of customer information.

For user accounts registered directly with GolfStatus, profile information is protected by the password each member uses to access their online account. It is important that you protect and maintain the security of your account and that you immediately notify Us of any unauthorized use of your account. If you forget the password to your GolfStatus account, the Service allows you to request that instructions be sent to you that explain how to reset your password. When you sign into your account or enter payment information (such as a credit card number when purchasing virtual currency), we encrypt the transmission of that information using secure socket layer technology (“SSL”). While we take reasonable precautions against possible security breaches of our websites and our customer databases and records, no website or Internet transmission is completely secure, and we cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur. We urge you to take steps to keep your personal information safe (including your account password), and to log out of your account after use. If your SNS account is hacked, this may lead to unauthorized use of your GolfStatus account, so be careful to keep your account information secure. Unfortunately, the transmission of information over the Internet is not completely secure. Although we strive to protect your personal data, we cannot guarantee the security of your data while it is being transmitted to our site; any transmission is at your own risk. Once we have received your information, we have procedures and security features in place to try to prevent unauthorized access.

International Users

If you are located outside of the United States, please note that the Service is hosted on computer servers in the United States. Therefore, your information may be processed and stored in the United States. As a result, the governments, courts, or law enforcement or regulatory agencies may be able to obtain disclosure of your information through laws applicable in the United States. Your use of this site or submission of any Personal Information will therefore constitute your consent to the transfer of your Personal Information outside of your home country.

State Privacy Rights

For California Residents

The CCPA provides California residents with rights regarding their personal data. To exercise these rights, please contact us as set forth below.

Right to Know and Data Portability

You have the right to request that we disclose certain information to you about our collection and use of your personal data over the past 12 months (the "right to know"). Once we receive your request and confirm your identity, we will disclose to you the categories of personal data we collected about you; the categories of sources for the personal data we collected about you; our business or commercial purpose for collecting or selling that personal data; the categories of third parties with whom we share that personal data; if we sold or disclosed your personal data for a business purpose, additional information disclosing sales, identifying the personal data categories that each category of recipient purchased; and disclosures for a business purpose, identifying the personal data categories that each category of recipient obtained; and the specific pieces of personal data we collected about you (also called a data portability request).

Right to Correct

You have the right to request that we correct any inaccurate personal data we maintain about you.

Right to Delete

You have the right to request that we delete any of your personal data that we collected from you and retained, subject to certain exceptions (the “right to delete”). Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

1.       Complete the transaction for which we collected the personal data, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.

2.       Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

3.       Debug products to identify and repair errors that impair existing intended functionality.

4.       Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

5.       Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).

6.       Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.

7.       Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

8.       Comply with a legal obligation.

9.       Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

We will delete or deidentify personal data not subject to one of these exceptions from our records and will direct our service providers to take similar action.

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information.  We cannot respond to your request or provide you with personal data if we cannot verify your identity or authority to make the request and confirm the personal data relates to you. You do not need to create an account with us to submit a request to know or delete. We will only use personal data provided in the request to verify the requestor's identity or authority to make it.

You may only submit a request to know twice within a 12-month period. Your request to know or delete must:

·         Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

·         Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us.

We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format

We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact [email protected].

We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal data that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

You do not need to create an account with us to exercise your opt-out rights. We will only use personal data provided in an opt-out request to review and comply with the request.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

·         Deny you goods or services.

·         Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

·         Provide you a different level or quality of goods or services.

·         Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal data’s value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

Other States

Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:

  • Confirm whether we process their personal information.

  • Access and delete certain personal information.

  • Correct inaccuracies in their personal information, taking into account the information's nature processing purpose (excluding Iowa and Utah).

  • Data portability.
